Dávila is incommunicado and without the right to private defense

After the arrest of the former parliamentarian by state security officials on August 8 during a vigil for political prisoners in Los Palos Grandes, Caracashis defense has presented briefs to the Public Ministry and the Ombudsman’s Office to demand precise information from the opponent and denounce the impossibility of exercising an effective judicial remedy.

“He was denied the right to file a habeas corpus and none of the investigations that we have requested have been successful,” reported lawyer Ezequiel Monsalve, legal coordinator of Defend Venezuela, to The National.

Monsalve also denounced Dávila’s return to El Helicoide on October 16.

“Mr. Dávila was taken without a court order or justification to Sebin Helicoide, without a medical discharge, which put his health at risk, returning to the clinic the next day. However, the preliminary hearing did not take place and we are still waiting,” he said.

He added that the conditions of detention of the political leader have not changed and that the public defender assigned by the State has not taken steps to complete his defense.

“Until now the same conditions have been maintained, he has not been allowed to appoint a trusted defender or participate in the investigation phase of his case,” said the lawyer.

Regarding the patient’s condition and his stay in the hospital, the legal coordinator of Defiende Venezuela stated: “It corresponds to a less burdensome measure that the State must grant to prevent his return to the detention center due to his delicate health condition.”

International support

Dávila has received support from the national and international community. Leaders and human rights organizations have demanded his immediate release.

“We demand that Williams Dávila be released and provided with the medical assistance he so urgently requires. The dictatorial regime of Maduro is responsible for his well-being and that of all other political prisoners in Venezuela,” said Luis Almagro, secretary general of the Organization of American States (OAS), in a statement through his social network X this weekend.

Senator Rick Scott, of the Republican Party, spoke about the opponent’s case and described Nicolás Maduro as a “monster” who will stop at nothing to silence democracy activists.

“I am deeply concerned about Dávila’s critical state of health after months of unjust imprisonment by the illegitimate Maduro regime. The world is watching closely. “It is in Maduro’s interest to release Dávila and the thousands of hostages he has held hostage sooner rather than later!” Scott warned.

On August 14, the Inter-American Commission on Human Rights (IACHR) issued a resolution to monitor and modify the precautionary measures, in which it expressed deep concern about the leader’s situation.
